Assisting Pennsylvania Farmers Who Were Injured on the Job

Workers’ Compensation is Available for Farmers and Agricultural Workers

Most Americans have a “romantic” idea about farming: something about making the land yield to us is deeply ingrained in our idea of America is. But farming and agricultural work is extremely tough, and very dangerous. It is grueling work with long hours in all sorts of weather, requiring the use of heavy machinery and sometimes toxic chemicals. Whether you work a small dairy or sheep farm outside of Lancaster or raise chickens for a large-scale poultry company, your risk of being seriously injured is higher than most other industries.

At Larry Pitt & Associates, P.C., we understand exactly how dangerous agricultural work really is. Our dedicated workers’ compensation lawyers fight on behalf of farm employees who have sustained a serious injury or developed a life-changing illness as a result of their work. The laws governing farmers and agricultural workers in regards to workers’ compensation are highly complex, and speaking to a member of our legal team can mean the difference between obtaining the benefits you need and going without them.

How Dangerous is Farming, Really?

CBS News reported that “The U.S. Bureau of Labor Statistics reports that there is an average of 63 fatal injuries and 12,500 nonfatal injuries and illnesses involving animals every year” – and that doesn’t even take into account the dangers of working on a farm without animals. Regardless of what you raise or grow, the chances are high that you might:

These are the types of injuries that can prevent you not only from returning to the farm, but from doing other types of work, too. Workers’ compensation allows you to take the time you need to recover from your injury or illness while still providing for your family. If you paid into the system, you have earned the right to use it when you need it.

Complex Legal Matters Surrounding Agricultural Work

For all the good that farmers do, most states provide little to no recourse for injured farm workers. Pennsylvania does allow farm workers to collect workers’ compensation, but on a limited basis: “Employer[s] must provide workers’ compensation if the employer pays one agricultural worker wages of $1,200 or more, or furnishes employment to one employee in agricultural labor for 30 or more days in a calendar year.” This limitation excludes a lot of family farmers as well as day laborers.

But that does not mean you are out of options. If you cannot collect workers’ compensation for your injuries, you may still be able to file a third-party personal injury claim. Our firm has more than three decades of experience in both areas of law, and can inform you of your rights and help you plan for your future.
