Workers' Compensation Law

Workers who are injured at work, due to work, or suffer from a work-related illness, may be entitled to recover workers’ comp benefits under Pennsylvania law. While the law and the workers’ comp board have created a streamlined process to obtain these no-fault benefits, some applicants may find that their claims are denied or underpaid. This is particularly true if a worker has a pre-existing injury or may have caused his or her injuries. However, our lawyers know that these considerations should not decrease or bar a claim for a worker who was truly injured by a work-related injury or illness.

If you believe that your workers’ compensation benefits or award is unfair and unjust, call us at Larry Pitt & Associates to learn how we can help you. Whether you were just injured and about to apply or have been unfairly compensated, call an experienced workers comp lawyer in Sharon Hill, PA, to schedule a FREE consultation.

Workers’ Compensation Insurance Overview

Also known as WC or workers’ comp, workers’ compensation is a no-fault benefits program sponsored by employers for the benefit of their employees. Nearly all employers must have workers’ compensation insurance, and almost all workers—even part-time or seasonal workers—are eligible for benefits. The fact that it is a no-fault program means that liability does not need to be proven, and a workers’ comparative fault in causing his or her injuries is not relevant.

Rather, the main criteria for eligibility is that the injury or illness is work-related. Examples of covered work-related injuries or illnesses include the following:

  • Slip and falls
  • Explosions
  • Falling equipment or debris at a worksite
  • Workers falling from a height
  • Chemical exposure
  • Toxic mold
  • Fires
  • Repetitive use injuries
  • Burns
  • Electrocutions, and
  • Other types of accidents or conditions that could cause an injury or illness.

What are Workers’ Compensation Benefits?

However, an injured worker may be entitled to other types of benefits. These usually come if a worker has suffered some type of permanent injury or illness that has reached maximum medical improvement (MMI). This can include disfiguring scars.

If a worker was killed in a work-related accident, the family may also be entitled to death benefits.

How Workers’ Comp Benefits Are Paid

Typically, workers’ compensation benefits are paid in regular intervals like a regular paycheck. This can continue for many months or years as a worker heals. However, workers may also be offered a lump sum settlement. This cannot be requested but is offered by the workers’ comp adjuster as a settlement to stop regular payments and compensate a worker for his or her injuries, medical bills, and permanent disability from now until his or her life expectancy.

This lump sum payment is often substantial and helpful for some individuals who may need to move due to their disability or make home modifications. However, it is not helpful for individuals who may have difficulty managing money.
