What is Workers’ Compensation?
Under Pennsylvania law, injured workers are entitled to recover compensation for their medical bills and up to two-thirds (2/3) of their lost wages for work-related injuries or illnesses. Workers may also be entitled to other benefits for permanent injuries and disabilities that may prevent them from working or otherwise impact their daily lives.
Nearly all employers are required to obtain workers compensation insurance for their workers, and workers comp benefits cover almost all employees. This includes part-time, seasonal, and temporary workers.
In return for this no-fault benefits program, workers must establish that their injuries are work-related or their illness is work-related. Workers do not need to establish causation or fault, and they can still recover workers’ compensation benefits if they were partially at fault.
Can I Sue My Employer for a Work Injury or Illness?
No, not usually. Workers comp benefits are intended to be the exclusive remedy. The limited exceptions to this include where an employer did not submit the claim in a timely manner, where an employer did not have workers comp insurance but should have, or other rare circumstances.
However, a worker may be entitled to file a lawsuit against a third party, such as another driver or business that caused harm in a motor vehicle accident while at work—so long as that person was not your employer or co-worker.
