Workers’ Compensation for Injured Commercial Truck Drivers

How Truck Drivers Can Determine if they are Eligible

Like all major cities, Philadelphia sees a lot of commercial trucks carrying goods to homes and businesses, and shipping products out to places around the country. The men and women who drive those trucks help keep our country going, and they do it under some of the worst circumstances possible: in bad weather, in bumper-to-bumper traffic, and on narrow roadways with double-parked cars. When a truck driver is injured during the course of his or her duties, that driver may be entitled to workers’ compensation benefits to help them recover. At Larry Pitt & Associates, P.C., our experienced workers’ compensation lawyers are proud to represent commercial truck drivers, and to help them get back on the road to recovering as smoothly and as quickly as possible.

Employees vs. Independent Contractors

A number of commercial truck drivers are considered independent contractors, which means they work for whomever they want, whenever they want. Unfortunately, independent contractors are not eligible to collect workers’ compensation unless they have accepted full employment (even on a temporary basis) by an agency. In other words, if you are employed by ABC Trucking, Inc., it doesn’t matter which company you’re driving to and from: all that matters is that you are contributing to the workers’ compensation fund through your taxes, and are therefore eligible to collect benefits. If you are not working for a company or agency, you may still be able to file a third-party personal injury claim, but you cannot receive workers’ comp.

Injuries Sustained by Truckers

People talk about the types of injuries passenger vehicles sustain when they have an accident with a tractor-trailer, but they don’t spend too much time thinking about how easily truck drivers can be hurt, too. At Larry Pitt & Associates, P.C., we help truck drivers obtain workers’ compensation benefits after they have sustained:
