Employees vs. Independent Contractors
A number of commercial truck drivers are considered independent contractors, which means they work for whomever they want, whenever they want. Unfortunately, independent contractors are not eligible to collect workers’ compensation unless they have accepted full employment (even on a temporary basis) by an agency. In other words, if you are employed by ABC Trucking, Inc., it doesn’t matter which company you’re driving to and from: all that matters is that you are contributing to the workers’ compensation fund through your taxes, and are therefore eligible to collect benefits. If you are not working for a company or agency, you may still be able to file a third-party personal injury claim, but you cannot receive workers’ comp.
